CAPTAIN’S RESPONSIBILITY

The Charleston Ocean Racing Association (CORA) frequently runs races in which the participating vessels encounter severe weather conditions, and indeed, the sport of sailboat racing involves some inherent risks to life, limb and property. However, the safety of a yacht and her crew is the sole and inescapable responsibility of the captain, who must insure that the yacht is sound, sea-worthy and manned by experienced, capable crew who are physically fit. The establishment of minimum equipment regulations in no way reduces or limits this responsibility. The captain must further insure that all equipment is properly maintained and stowed, and that the crew knows where it is kept and how it is to be used. It is the sole and exclusive responsibility of the captain to decide whether or not to start or continue in any race. It is the responsibility of the captain to take all reasonable precautions to prevent underage drinking by his crewmembers, and to prevent any disorderly conduct on the part of his crew at our shore side gatherings.

CORA bears no responsibility for accidents, damage or injuries to yachts or their personnel arising from any cause during these races or related activities.

CERTIFICATION AND WAIVER

I hereby certify that I have read the above entitled CAPTAIN’S RESPONSIBILITY as well as the ORC MINIMUM EQUIPMENT AND ACCOMMODATION STANDARDS, category 4, that the yacht designated below conforms to these standards in all respects and that all equipment will be on board at all times during those CORA races designated as category 4. I hereby certify that the yacht designated below shall conform to any other safety regulations as required by the sailing instructions.

I hereby agree that neither I nor any of my crew shall hold CORA nor any of its officers, governors or committee members responsible for accidents, damage or injuries during the races or related activities. No crew member will be aboard my boat who has not consented to this waiver in his or her behalf.

Nothing herein shall waive any claim, which my crewmembers or I may have against any officer or member of CORA acting in his or her individual capacity as a participant in the races as a captain or crewmember competing In these races.
